GENERAL TERMS AND CONDITIONS OF ONLINE SALE

These General Terms and Conditions of Sale apply to ticket purchases made for non-professional purposes through the website, https://parquemagicasnavidades.es/

Accessing and using this ticket sales website implies knowledge and acceptance of the general terms and conditions of use and sale of https://parquemagicasnavidades.es. Furthermore, in case of any contradiction, doubt or omission, the general terms and conditions of use and sale shall apply.

  • DEFINITIONS

For the purposes of these General Terms and Conditions of Contract, the following terms shall be interpreted in accordance with the following definitions:

  • GENERAL TERMS AND CONDITIONS: the General Terms and Conditions of Contract governing the contract entered into by the CUSTOMER.
  • SERVICES: the services that MÁGICAS NAVIDADES offers the CUSTOMER for purchase through the website, designed to enable the CUSTOMER to buy tickets for all types of events.
  • CUSTOMER: a user of the website who purchases the services provided through it by MÁGICAS NAVIDADES.
  • By completing the purchase process, the CUSTOMER confirms that they are legally able to carry out the transaction and that they are over 16 years of age or, at the very least, have the authorisation of their legal guardian.
  • SCOPE OF APPLICATION
  1. These General Terms and Conditions apply to the purchase of tickets and, where applicable, to the user registration provided by MÁGICAS NAVIDADES. The General Terms and Conditions will be made available to Customers, with the legally required notice, on the website https://parquemagicasnavidades.es. The Customer is therefore advised to read the General Terms and Conditions carefully before submitting their personal data and the purchase data through which the ticket sale offered by MÁGICAS NAVIDADES is formalised.
  2. Through the ticket sales website, users may purchase advance tickets for events held by MÁGICAS NAVIDADES. The advance ticket sales service is generally available 24 hours a day, 365 days a year. However, MÁGICAS NAVIDADES may suspend the advance sale of all or some of the tickets for events it organises at any time, temporarily or permanently, without prior notice.
  • SALES PROCESS

Customers can buy tickets on the website by following the steps of the process, which involves selecting the Products and quantity they wish to purchase, making payment and providing the personal information needed to receive the purchase confirmation and proof of admission, and for the Products to be sent electronically. Each step of the sales process is explained on the website. Customers can check their order and make any corrections before proceeding to payment.

At the time of purchase, Customers can consult these General Terms and Conditions of Sale and the privacy statement. Purchasing Products implies acceptance of these Terms and Conditions and the privacy statement.

  • PAYMENT

Products may be paid for using the electronic payment methods available on the website. Customers shall bear any charges imposed by their bank for transferring the purchase amount to MÁGICAS NAVIDADES.

Customers may be eligible for a reduced rate by entering discount codes on the website. MÁGICAS NAVIDADES may request supporting documents to confirm that the Customer is entitled to the reduced rate.

All purchases must be paid for immediately. MÁGICAS NAVIDADES reserves the right to refuse or cancel an order if there are signs of fraud.

  • DELIVERY

Unless expressly stated otherwise on the website, Products will always be delivered electronically, by means of a purchase confirmation and proof of admission sent to the email address provided by the Customer. The Customer is responsible for the validity of the email address provided and must ensure the proper functioning and security of the email program used to receive the Products. The Customer bears the risk of loss of Products sent electronically from the moment the email is delivered to the Customer’s email provider.

Customers will always receive a purchase confirmation email with a summary of the basic purchase information. It is the Customer’s responsibility to keep this email. If the Customer does not receive the purchase confirmation email for the Products ordered, they should contact MÁGICAS NAVIDADES at taquillas@productoresdesonrisas.com

The ticket purchase confirmation contains proof of admission or a link to it. The proof of admission, printed and/or displayed on a smartphone, entitles the Customer to enter the MÁGICAS NAVIDADES venues.

Each proof of admission and booking code is unique and may not be modified, copied or reused unless expressly stated otherwise.

  • BUYER’S RIGHTS. EXCHANGES, DUPLICATES, REFUNDS AND GENERAL CANCELLATIONS
  1. In accordance with the regulations governing the sale of tickets for public shows and recreational activities, there is no right of withdrawal.

Once tickets have been purchased, no exchanges, refunds or cancellations will be accepted, except through the cancellation or exchange service, which allows a 100% refund of the amount paid, with tickets cancellable up to 24 hours before the event.   1. In the event of technical, artistic, organisational, audiovisual or production needs, MÁGICAS NAVIDADES reserves the right to reassign seats/places already sold and replace them with others of equal or higher category or, where applicable, to refund the amount paid.
  2. For online purchases, users of this service will receive their tickets by email in PDF format, which is valid and sufficient for admission to the corresponding show.
  3. Cancellation before the start of the performance or a substantial change to the show shall be the only admissible grounds for a refund of the ticket price; a change in the cast shall under no circumstances be considered a substantial change. Where applicable, refunds may be made by offering vouchers in lieu of reimbursement. In any case, service and/or booking fees are non-refundable.
  4. No refund shall be due where the cancellation or change occurs after the show or recreational activity has begun and is due to force majeure.
  5. For technical or artistic reasons or force majeure, MÁGICAS NAVIDADES reserves the right to alter the nature of the planned production, as well as the advertised dates, times, programmes and performers.
  6. MÁGICAS NAVIDADES prohibits the resale of tickets and only guarantees the authenticity of tickets purchased through official channels. Tickets purchased through channels that are not official or not expressly authorised by MÁGICAS NAVIDADES will not be valid, without prejudice to any administrative and criminal liability that may arise.
  • REQUIREMENTS FOR PURCHASE
  1. Personal requirements. Purchasing from MÁGICAS NAVIDADES is intended for end Customers over the age of 16, for their own use or that of persons on whose behalf the Customer is legally authorised to act. Wholesale companies, agencies, distributors and other professional intermediaries are excluded.
  2. Other requirements. In order to comply with the legal obligation of every Information Society Service Provider to confirm to the customer that the purchase has been completed, the Customer must have an email address and provide it to MÁGICAS NAVIDADES using the field provided for this purpose during the purchase process.
  3. MÁGICAS NAVIDADES will keep the electronic document formalising the contract for a period of two years and will send a copy to the address provided by the Customer as confirmation of the purchase.
  4. MÁGICAS NAVIDADES is bound at all times to comply with the requirements of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.
  • PROCESSING OF PERSONAL DATA
  1. In accordance with Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), and other applicable legislation, MÁGICAS NAVIDADES informs the customer that the personal data entered in this form will be included in the databases for which it is responsible and processed automatically for the purpose of managing and fulfilling the obligations inherent to the purchase process and the management of its own services. These personal data will also be included in the MÁGICAS NAVIDADES database for reference in the event of any issues with the tickets or services purchased.
  2. Nevertheless, any data provided by users may be processed by MÁGICAS NAVIDADES as Data Controller, and will at all times be stored and processed within European territory.

Your data may also be processed by other group companies, depending on the event you attend, for the purpose of managing ticket payments and payment gateways. Your data will be disclosed to the following group companies:
