These General Terms and Conditions of Sale apply to ticket purchases made for non-professional purposes through the website https://parquemagicasnavidades.es/

Access to and use of this ticket sales website implies knowledge and acceptance of the general terms and conditions of use and sale available at https://parquemagicasnavidades.es. Likewise, in the event of any contradiction, doubt, or omission, the general terms and conditions of use and sale shall apply.
DEFINITIONS
For the purposes of these General Terms and Conditions of Contract, the following terms shall be interpreted as follows:
GENERAL CONDITIONS: General Terms and Conditions of Contract governing the agreement entered into by the CLIENT.
SERVICES: Services offered by MAGICAS NAVIDADES to the CLIENT through the Website, intended to facilitate the purchase of tickets for all types of events.
CLIENT: User of the Website who contracts the services provided by MAGICAS NAVIDADES through it.
By completing the purchase process, the CLIENT confirms that they are legally capable of carrying out such an operation, that they are over 16 years of age or that they have, at a minimum, the authorisation of their guardian.
SCOPE OF APPLICATION
These General Conditions apply to the purchase of tickets and, where applicable, to the user registration provided by MAGICAS NAVIDADES. The General Conditions will be available to Clients on the website https://parquemagicasnavidades.es with the legally required advance notice. It is therefore advisable for the Client to read these General Conditions carefully before submitting personal data and purchase details, through which the sale of tickets offered by MAGICAS NAVIDADES is formalised.
Through the ticket sales website, users may purchase tickets in advance for events held by MAGICAS NAVIDADES. The advance ticket sales service is generally provided 24 hours a day, 365 days a year. However, MAGICAS NAVIDADES may suspend, at any time and without prior notice, temporarily or permanently, the advance ticket sales service for all or part of the events organised by MAGICAS NAVIDADES.
SALE PROCESS
The Client may purchase tickets through the website by following the steps of the process, which consist of indicating the Products they wish to buy and the quantity, making payment, and providing the personal information necessary to receive the purchase confirmation and the ticket voucher, and for the Products to be sent electronically. Each step of the sales process is explained on the website. The Client may review their order and make any necessary corrections before proceeding to payment.
At the time of purchase, the Client may consult these General Terms and Conditions of Sale and the Privacy Statement. The purchase of Products entails acceptance of these Terms and Conditions and of the Privacy Statement.
PAYMENT
Products may be paid for through the electronic payment methods available on the website. The Client shall bear any charges imposed by the bank for transferring the amount of the purchase of Products to MAGICAS NAVIDADES.
The Client may obtain a reduced rate by applying discount codes on the website. MAGICAS NAVIDADES may request supporting documents to confirm that the Client is, in fact, entitled to such a reduction.
All purchases shall be paid immediately. MAGICAS NAVIDADES reserves the right to refuse or cancel an order if there are indications of fraud.
DELIVERY
Unless expressly stated otherwise on the website, delivery of Products shall always be carried out electronically, via a purchase confirmation and a ticket voucher sent to the email address indicated by the Client. The Client shall be responsible for the validity of the email address provided and must ensure the proper functioning and security of the email programme used to receive the Products. The Client shall assume the risk of loss of Products sent electronically from the moment the email is delivered to the Client’s email provider.
The Client will always receive an email confirming the purchase and a summary of the basic information relating to it. It is the Client’s responsibility to keep this email. If the Client does not receive the purchase confirmation email for the requested Products, they must contact MAGICAS NAVIDADES at the email address taquillas@productoresdesonrisas.com.
The purchase confirmation of tickets contains an access voucher or a link to that voucher. The access voucher, printed and/or displayed on a smartphone, entitles the Client to enter the MAGICAS NAVIDADES venues.
Each ticket voucher or booking code is unique and may not be modified, copied, or reused, unless expressly stated otherwise.
BUYER’S RIGHTS. EXCHANGES, DUPLICATES, RETURNS OR GENERAL CANCELLATIONS
In accordance with the regulations governing the sale of tickets for public shows and recreational activities, there is no right of withdrawal.
Once tickets have been purchased, no changes, refunds, or cancellations will be accepted, except through the hiring of the cancellation or change service, under which a 100% refund may be obtained, allowing tickets to be cancelled up to 24 hours before the event. For technical, artistic, organisational, audiovisual, or production needs, MAGICAS NAVIDADES reserves the right to reassign already-sold seats and replace them with others of equal or higher category, or, where appropriate, to refund the amount paid.
For online purchases, users will receive the tickets by email in PDF format, which shall be valid and sufficient to access the corresponding show.
Suspension prior to the start of the performance or substantial modification of the show shall be the only admissible grounds for the refund of the ticket price; a change in the cast shall not, in any case, be considered a substantial modification. Where applicable, the refund may be made by offering vouchers or credits instead of reimbursement. In any event, service and/or management fees are non-refundable.
No right to a refund shall arise in cases where the suspension or modification occurs once the show or recreational activity has begun and is due to force majeure.
MAGICAS NAVIDADES reserves the right, for technical, artistic, or force majeure reasons, to alter the nature of the planned production, as well as the announced dates, times, programmes, and performers.
MAGICAS NAVIDADES prohibits the resale of tickets and guarantees only the authenticity of tickets purchased through official channels. Tickets acquired through unauthorised or unofficial channels shall be invalid, without prejudice to any applicable administrative and criminal liabilities.
REQUIREMENTS FOR CONTRACTING
Personal requirements. The ability to contract with MAGICAS NAVIDADES is intended for end Clients over 16 years of age and for the Client’s own consumption or for the persons on whose behalf the Client is legally authorised to act. Wholesale companies or agencies, distributors, and other professional intermediaries are excluded.
Other requirements. To comply with the legal obligation applicable to every Information Society Service Provider to confirm to the customer the effective completion of the purchase, the Client must have an email address and provide it to MAGICAS NAVIDADES through the field provided for this purpose during the contracting process.
MAGICAS NAVIDADES shall keep the electronic document formalising the contract for a period of two years and will send a copy to the address indicated by the Client as confirmation that the purchase has been completed.
MAGICAS NAVIDADES is at all times obliged to comply with the requirements set out in Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.
PERSONAL DATA PROCESSING
In accordance with Regulation (EU) 2016/679, Directive 95/46/EC (General Data Protection Regulation – GDPR) and other applicable legislation, MAGICAS NAVIDADES informs the Client that the personal data provided in the relevant forms will be incorporated into its databases, for which it is responsible, and processed automatically for the purposes of managing and fulfilling the obligations inherent to the purchase process and the management of its own services. In addition, such personal data will also be incorporated into the MAGICAS NAVIDADES database for consultation in the event of possible incidents with tickets or contracted services.
Notwithstanding the foregoing, the data provided by users may be processed by MAGICAS NAVIDADES, as Data Controller, and will be stored and processed at all times within European territory.
Likewise, your data may be processed by other group companies depending on the event you attend and will be processed for the management of ticket payments and payment gateways; your data will be shared with the following group companies:

An express refusal to provide data classified as mandatory will result in the service or information requested not being provided. Purpose of processing: MAGICAS NAVIDADES may request personal data through different forms, which form part of the databases owned by MAGICAS NAVIDADES, solely for the purpose of carrying out its activities.
By using the forms and contact email accounts of MAGICAS NAVIDADES, you must grant your express consent, via the opt-ins enabled for this purpose, for the processing of your personal data for the following purposes:

• To send information regarding events and publications, and commercial information by different means about MAGICAS NAVIDADES, its activities, services, offers, and promotions, as well as about entities with which MAGICAS NAVIDADES has collaboration agreements.
Legal basis for processing. The processing of your data for non-informational purposes is based on your consent upon providing them at the time of purchasing Products.
The processing of data for the sending of information is based on the data subject’s consent to maintain a communication channel that allows continuous knowledge of updates relating to MAGICAS NAVIDADES.
Under its legitimate interest, MAGICAS NAVIDADES may carry out processing that is strictly necessary for the internal administration of the website, statistical analysis of visits to the website, and user behaviour.

· DNI, front side, masking all data except name and surname(s).
In all cases, once your identity has been verified, we will handle your rights request without unnecessary steps or additional forms, and we will inform you clearly and promptly of the status of your request.

MAGICAS NAVIDADES reserves the right to modify this Privacy and Data Protection Policy to adapt it to legislative developments; we therefore recommend that you read it before each access and when browsing the website. Notwithstanding the foregoing, relationships established with users prior to modification of the Privacy Policy shall be governed by the rules in force at the time the user accessed the website to establish such relationships, without prejudice to the provisions of the General Data Protection Regulation.
APPLICABLE LAW AND COMPETENT COURTS
Spanish law shall apply. For the resolution of any type of dispute that may arise from the use of this website, as well as from registration or contracting that may be carried out through it, the Courts and Tribunals of the city of Madrid are declared to have jurisdiction.
